Judge Issues Ruling in Daniel Boone National Forest Fight
PICKERINGTON, Ohio -- A federal judge has dismissed a lawsuit to reopen
motorized-recreation trails in Kentucky's Daniel Boone National Forest, reports
the American Motorcyclist Association (AMA).
The AMA, the Ohio Valley Trail Riders and the Blue Ribbon Coalition filed
a federal lawsuit in March of last year seeking to reverse a U.S. Forest Service
closure of some 700 miles of motorized trails in the Daniel Boone National
Forest. The Forest Service action closed nearly 90 percent of the Daniel Boone
trails that had been open to motorcyclists and ATV riders.
The suit charged that the Forest Service had failed to follow proper
procedures in instituting the trail closure, and failed to consider alternatives
that would have allowed the continued use of more trails.
In a decision issued July 7, Judge Jennifer Coffman of the U.S. District
Court, Eastern District of Kentucky, dismissed the lawsuit saying, among other
things, that the Forest Service followed proper procedures and properly
described and analyzed alternatives.
No decision has been made on whether to appeal.
