Cops!

Thanks Ivan, It's a tough situation for me though. There is not another place to ride for 60-70miles. And if I have to wait to go riding there then I basically don’t get to ride much at all. I will just have to figure this out on my own, I know the facts the decision is up to me now.

Ever since I got more serious about racing and training, I never have time to ride my bike behind the house or in a field, it's almost strictly closed course competion now :)

I have had a few run-ins with the local cops myself. In fact, I got stopped twice this year. I was lucky he only gave me a simple warning (the benefit of living in a small town), but he warned that if he catches me again, he'll give me every ticket he can.

I figure with a warning like that, he just gave me the Green Light to out run him next time. That sucks that KXer got caught, but now you know what to do next time.

First off, I accept full responsibility for riding there, even did not know that it was off limits. Seeing as many other people riding there as we did would suggest that it was ok. Second, I'm not whining. I am from northern ID, where you can pretty much ride wherever you want as long as it is not posted. Up there, if it is not posted, it is legal. I realize california is a little different, but hey, SoCal used to be the dirtbike capital of the world.... The reason I am pissed is because the cop tricked us into thinking he just wanted to check our ID's and VINs instead of telling us that we were going to be cited from the get-go. That would have been fine. Also, he treated us like criminals, not even wanting to hear our side of the story.

Furthermore the place we were riding at was not private property. The place were we entered was private, for about 100ft. and we had permission to be there. We also walked the bikes with them off through this area. The way back to our trucks that the cop took us was private and he had us ride in front of him through this spot. He stopped us when we were almost to the pavement and showed us what was a hardly legible, rusted, bent up no- trespassing sign. After we got to the pavement, we were still a few miles from the trucks, because the cop made us exit the area where he could get his blazer out. He then escorted us (riding) through a residential area on the street, all the way back to our trucks. So, I guess it's ok to ride through the streets in a residential area, but not legal to walk your bike through a place where you have permission to ride, only to have a cop take you back a way that is illegal to ride and then site you for it?

With all due respect Okie, do you think we should have just layed down and took it or tried to explain (which isn't whining)? Am I still totally in the wrong for being pissed?

Running just gives us a bad image. SHAME ON THOSE WHO RUN!!! If you don't have the balls to talk to a cop you shouldn't be on a dirt bike.

Getting pissed for getting caught , normal reaction. Seems like you are trying to make some conspiracy out of it. Rather you knew you were allowed to or not is irrelevant... ignorance won't save you a ticket. It's simple; you weren't allowed to ride there, you got a ticket. Deal with it. I still don't see what the issue is.

I'm not pissed that I got caught. Like I said before, I accept responsibility for that. Im pissed because we were instantly treated like felons, just because we were on dirtbikes. There were others out there, quads, mountain bikes, walking, etc. The place where we were riding inflicted no damage to the land or other people, both physically and acoustically. It was not posted as a non motorized vehicle area. It was not posted at all for that matter, except the single bent, corroded sign that the cop took us by.

And don't run for heaven's sake. WE, as a riding community, don't need it and you sure don't in that off chance that you crash and get caught. Believe it or not, it does happen. How bad would you feel if the cop crashed chasing you? I should hope you'd reconsider!

And I wouldn't run. I'm not a criminal; even though I do ride a noisy, polluting, earth deforming two stroke:cool:

The dart thing was for the other guys. I let them feel good by beating me up!!!!:):) I can handle the aggression, I'm a trained professional you know!
Nobody is happy about getting caught, I agree. Just roll with it and remember that the cop is a human too, like you. He may have been tired of chasing guys all day that won't stop for him so he used the ploy to make sure you wouldn't run. WE have bad days too, trust me. Damn smitty!:)

Now if the land owner has had an ongoing battle with the bikers, then you are out of luck, the cop is just doing his job, you got caught

I do believe that the punishment should fit the crime. Sometimes making an example of someone can be counter productive.

"Son, you can't ride here"
"Okay Mr. Officer, I made a mistake"
"Promise me you won't ride here anymore"
"yes sir"
"Okay then, here's a loli-pop, be on your way"

How about
"Son, are you aware that you are tresspassing"
"No, sir I had no idea"
"Ok, let me check those ID's and VINs"
"yes sir"
"Alright then, I have your ID's, your VIN's, don't let me catch you here again, next time I will know who you are, and will throw the book at you"
"Yes sir, sorry sir, it won't happen again"
"Yeah, now get the heck out of here" :think

I guess some of us have never been given a break before. :(

BTW, I spent four years working for the dept of corrections in facilities all around the country (South Africa), have seen the scum of the earth, have spent time on death row facility, know that if you do the crime, you will do the time.

To serve and protect, some cops have a better understanding of this principle, others not !

I'd venture to say there is probably more he failed to mention. Same old story ... police man bad for busting me. I not deserve it, I not doing nutting wrong, I not know., it not fair. Then you grow up.

I said that the no trespassing sign was no where near where we came in and no where near where we were riding. The only sign was where the cop came in, which was miles away from where we originally were. I guess if there is a sign somewhere in alaska, I can't ride in Idaho.....

The only thing I didn't mention was the fact that I got two tickets. The second was because I didn't have a california green or red sticker on my bike. This is because it is legally registered in Washington, which california DMV said was all I needed (and I checked three times). The reason the bike is registered in Washington is because I am in the military, temporarily stationed in San Diego. I didn't mention this because I am sure I can get this thrown out.

Where is the legitimacy in this ticket?

And Okie, I might come off as an ignorant, stupid, trouble causing kid. Frankly, nothing could be further from the truth.

Hey I gotta represent! ;)

Once I spoke with a very nice officer who said he was seconds from ripping my head off until he realized I was a decent guy willing to talk. His almost direct words were, "I saw a black bike with a chrome pipe, I knew this guy is going to run for sure!"
Well I stopped and he seemed a bit impressed he yelled at first and pulled tough guy and I said I was sorry I was just changing the oil for a race. We ended up having a real nice chat, he said he was so fumed that 2 bikes ran from him a bit earlier and one even threw a rock into his windsheild chipping it:eek:
He ended up telling me why he had to stop me, what I shoud do next time, gave me his card if I had any problems,
he was a real nice guy

I just wish KX shared the same experience I did :(

Way back when I had my old '70s yz I was riding in this old lot, well this jeep came and started ripping things up and a cop came. We stopped and he said that since its unposted and the owner hasnt complained there is nothing he can do. I dont know about each states law but in ohio if there are no signs, and no one says anything, the cop cant do anything. We left and never came back though :)

Well private land is private land, but still some cops just have an attitude and sometimes non-land owners complaing just to be jerks. When I lived in Michigan, many years ago I had 8 acres and several neighbor kids would ride their quads and bikes on it when they couldn't get to the real riding areas. Several times neighbors complained and the police would arrive to ticket the trespassers. I would explain it was my land and they had no right to ticket them if I didn't say so. They really didn't like that, but they would leave. I even had a neighbor call the police once when I was riding there.

A ticket doesn't fit?

Some cops will write a ticket for anything, had an officer write me up for reckless driving when I was 18 and involved in a car accident, even the driver who hit me agreed it was an accident, had some trigger happy cop who wanted to throw the book at me, had to make three trips to court to prove I was not guilty, even had to have the guy who crashed into me speak to the prosecutor in my behalf. If I had not fought this, I would have had a criminal record, all for a lousy hundred buck fine ! - Maybe it had something to do with me being on a street legal dirt bike at the time !

I don't think he said he got caned did he?

Heck, I'd take a caning any day :p

Yeah, he forgot to mention he is a soldier, probably knows quite a bit about "serving and protecting" ! :)

in all honesty, how many of you really know who owns the land you are riding on and whether or not it is okay? i have ridden many places that someone said it was okay but for all i really know, it was not. i certainly didn't go to the courthouse and research the ownership records.

KXer, you did the right thing by stopin, wished i could do it over againa nd stop!

What are the laws on if someone lies to you, me and my friends went riding on some trails next to one of my friends house. We rode up to this guys house like 8 of us. He said he didnt care if we rode on his land, he told us to just be carful.

Then bout to or three hours later me and my buds came round a turn on our 125's running(like 4th or 5th gear). This guy was standing out int he middle of middle of the dirtroad, i was going to fats to stop but i tired. Then one of my friends stoped and he told him to stay right there that he had called the cops, then my friend said he herd the sirens and he took off.

My friend finally cought back up with us and told us and man we scaterd. We never even looked back just rode our harts out to get back to my friends house before the cops. Well we did i know i did the wrong thing by running but we were along way from the cops back in the woods and the guy didnt know my name or anything like that so i wasnt gonna turn my self in and get some big ticket when the guy didnt even know my anme or anything.

but could the cops have done anything to me if i had stoped, i mean the guy gave me permission to ride his land along with like 8 of my friends.
