I just googled both model year bikes, at a glance, I can't tell them apart.

If you have something like a bill of sale (you did get one right?), saying you purchased a 2004, you should have cause to sue this
guy in small claims court.

Of course, you haven't told us what you paid for the bike. It might just be best to forget the whole mess, and ride it!

How's the bike look? Is it in good condition, considering it's age?

Not to sure on what I can do about it yet I do have a bill for sale that says its a 2004 and it has the 98 vin on it. I payed 1800 for what it witch is a hard deal to pass up when I was told it was an 04. It my fault for not doing the research on the bike.

Email him or call him and tell him he made a mistake, and that the bike is a 1998. Tell him you wouldn't have paid more than $1400 for a 98 and you want $400 back. If he doesn't work with you, you can sue him, but most likely you will only get your $$ back and have to give the bike back to him. Small claims isn't a place where the judge would give you both.
