The following was sent out by the ASA:

The ASA Group filed a 60 day Notice of Intent to Sue with the BLM for non-compliance of the ESA's section seven consultation requirement on Friday the 25th of May.
The ESA requires the BLM to consult with the U.S. Fish & Wildlife Service before closing any areas. Since the judge ordered that the BLM was not relieved from any requirements of the ESA because of the lawsuit settlement and the ESA requires consultation with the U.S. Fish & Wildlife Service, the ASA Group says they are required to do consultation before closing any areas.

This is a separate issue from the lawsuit that has been filed by the ASA Group for non-compliance of NEPA and FLPMA.
