Well, as some of you know, I sold my 97 KX 250 on Saturday, and was very happy to see it go. I bought a CRF about 3 months ago, and had no need for the KX anymore. I put a new top end, new sprockets, graphics, and some other stuff on it to sale it a little faster. I found out 3 weeks ago that Im being laid off (Reduction in Force) from work due to budget cuts. I really needed to sale the KX so I could have a little backup cash in the case of it taking longer to get a job than Id like.

Saturday morning a guy called me about 9:30 am and wanted to come over to look at the bike. We agreed on 11:30 am after he went to the bank, and I got the bike out and started it up and made sure all was good. When he got to my house, he was impressed with it and thought it looked sharp. He hadnt ridden in a while, so I jumped on and tore down the street to go through all of the gears. He was satisfied with what he heard and saw and we came to an agreement on money. I wanted 2200.00, but he offered 2000.00, so I let it go for 2050.00. I was happy wit hthat and so was he and we loaded the bike up and he went on his way. I discussed giving him a bill of sale with the bike, as I had no MSO, but he said he had heard in OK it didnt matter if you got one or not, so we left it at that. I felt great after selling it.


Lets back up to March of 2002. I drove to Kansas to buy the KX in the first place. I cant remember the guys last name that I bought it from, but his first name was Rocky. I didnt get a BoS after buying the bike from him.

This morning I got a call from the OKC Police Dept. They said that the KX that I sold was stolen and had been reported stolen in Kansas in February of 2002. Ugggg. All that is going through my mind is that Im losing my job, I need the money, all the work and time I put in that bike, and losing my ass on it. It turns out that the guy that bought it was an MP at Tinker Air Force Base and he had a police buddy of his run the VIN to check it out.

When the police called me, they asked if I had a KX 250 with the serial of blah blah blah. I told them NO and that I had a Honda CRF, and that I had all of the papers from buying it. They then went into how the buyer ran the VIN, and it was stolen. I told them that I had no idea what they were talking about and that I never owned a KX. Was I wrong to do this? They cant prove that it was my bike as its not in my posession and the guy had no bill of sale from me.

The last thing that the detective told me was to bring the cash and myself to the station downtown before 5pm today and we could get it all worked out. I dont want to lose the 2050.00 bucks that I made from the sale. I need that money and times are tough. i really dont think they can prove it was mine or that I sold it to the Tinker AF guy. Its my word against his.

What do you all think? Should I just go down and explain where I bought it? Do you think they would believe me anyway?

I would go and explain it. It is tough, especially when you need the money but it is the right thing to do IMO.

I recently switched jobs and they gave me an extra paycheck. I called them and told them about it. It seems my Manager forgot to process the paper work. I thought I only had to pay them 2 weeks that I didn't work but b/c of how they do their pay schedule it actually is 3 weeks. I was not planning on that so now I have an extra weeks pay I have to pay back that I was not expecting to.

I could have called a friend of mine in HR and had things worked out to my advantage but I did it the right way and now have to pay back more than I thought and money I really don't have unless I cancel out on some racing. It was the right thing to do and I will pay it back in full even though it will hurt.

Good luck with your decision. I know my situation is different since you are being RIF'd. I hope you do what you are comfortable with.

I think I would try to find out exactly who reported it stolen. If the guy you bought it from reported it stolen (maybe trying to get your cash along with insurance $$) I would see if there was any way you could prove that you actually bought it from him. I don't suppose you wrote a check or gave him a money order etc?

That sucks but I don't know that I would risk getting into trouble by not telling the truth.

Be Honest about everything. Sure you got screwed, but lying about it would lead anyone to believe you have some quilty issues to hide. That's not the case here, so just tell them like it is.

Based on the timing... I would lay money on Rocky knowing your KX was hot.

You bought it March 2002 and it was reported stolen in Feb 2002. How long did Rocky say he had the bike? How many hours on it, how much work did he do to it, why did he sell it, and all that stuff? Sorry to say but he knew it was hot and pulled a fast one on ya Milk. It is highly unlikely that he innociently purchased a stolen bike, rode it for a few weeks, and sold it in 1 month.

Did you go to Rocky's house? Do you have ANY old stuff laying around with a possible name or phone number? Where did you find the bike for sale? Online ad? Paper ad? Word of mouth? Rocky is the bad guy.

Do you still have the VIN number - maybe Elk can dig up some background info.

By not being totally forthright, your actions will seem like that of a guilty person. You didn't do anything (knowingly) wrong, so don't play that part. It will only make you look guilty, or that you are trying to conceal something (like you knew it was stolen in the first place).

Don't know how they do it in other states, buy I received a certificate of title with my bike here in Michigan, just like a car. It includes liens on the bike, if any.

How do you, or can you, sell a bike with a lien on it? How do you knowingly buy a used bike without any liens without a certificate of title?

Great point! Wouldn't that be sweet justice on an insurance scam... The guy who reported it stolen name is "Rocky"...

You really are being serious? I hope not. I think it's best that he does EXACTLY what the police dept. is asking of him. I am sorry that he's out 2k. But sometimes ya gotta do the right thing regardless.

You sold a stolen bike, flat out, you did not know it was stolen but the bottom line is it was stolen. The guy that bought it shouldn't be out his money and unfortunately, you are one that possess such currency of his. It's a hard fact and I hate to tell you this but you need to give the money back. I know it sucks man

I'll feel bad for Milk up until the point that he takes his f'ed up situation and screws it up for himself even more by trying to "sneak" around. Other than that yes I agree this thread should be deleted as to not give anyone any ammo against him.

Well, I left work and came home to clean some things up. Im still not sure what I will do. I know the right thing to do would be to just go in before 5 and take the money. I really dont think its fair that I have to go down for something someone else did.

I listed the bike in the Bike Trader. It had my home phone number in it, but I think the ad has dropped off now. I should be ok there.

There is a black car parked about 3 houses down from me, and it looks like an unmarked squad car. Im probably just paranoid though.

I cant remeber the guys last name that I bought the KX from. Ive looked through all of my records and receipts, but I can find nothing. I can remember when I was driving off that I needed to go back for a bill of sale, but we were like 20 miles out of town and I didnt wanna go back. Guess I should have gone back.

Elk, I appreciate your thoughts of helping monetarily, but Im not going to need it. Im not going to go in to the station, and Im going to wait and see what happens. i really dont want to get anyone else here involved in this so Ill keep the cash and stash it Pred. Thanks anyway.

Some people will second guess me and be pissed. sorry. I had to do what I thought was right

I could not idly sit by and watch this happen
I will not let DRN or anyone else be needlessly implicated in milks troubles.
Hopefully some good will come of this in the end. doubtful, but hopefully

Is this some kind of joke? This could be a felony on you--it's only 2 grand, which by comparison, an income of 6 cents per hour making Oklahoma license plates, would put you @ 33,333 hours or 2777 days (12 hour days) or 7.6 years to pay back. :eek:

Don't you live in Norman? Isn't Tinker in Midwest City? How'd OKC get invlolved? You sold a 1997 for $2050? You should be locked up, you got away with robery. ;)
