Scotts Steering Damper installation question

I installed one of these guys on my 2001 Yamaha WR250F and even though the bolt on stem is square with the frame, the arm of the damper is not straight. (a little bit to the right when you are sitting on the bike) I also notice that the steering stops of the frame hit at just about the same time as the steering damper hits its stops. Seems like in a crash, the sheer pin could get broken.

In case anyone is curious, I just talked to both Scotts and my local Yamaha dealer and they both said that the reason the arm is a little crooked is because the steering stop (there is only one) was welded one a little crooked and other than my dampening being just a little off in one direction vs. the other, it will be fine. They also both said that the damper hitting it's stops the same time as the steering stops is fine. I guess if I tried to strighten the damper arm, I might hit a damper stop really early and break the shear pin.
